Terms of service
The terms Shelfwyze is provided under

These terms are an agreement between you and Shelfwyze (“we”, “us”). By creating an account or using the service you agree to them. If you are using Shelfwyze for a company, you confirm you are allowed to bind that company, and “you” means the company.
1. What the service is
Shelfwyze is software that helps food and beverage brands decide where to sell next and pursue those opportunities: retail targeting built from your connected data, pitch kits, a deal calculator, outreach and tracking. It is a decision-support tool. It does not place your products with any retailer, and nothing in the service is a promise that a retailer will list, meet with, or reply to you.
2. Your account
You need an account to use most of the service. Keep your password private and tell us promptly if you think your account has been accessed without permission. You are responsible for activity under your account. You must be at least 18 and able to enter a contract.
3. Your data and connected platforms
You own the data you enter and the data we read from platforms you connect, such as Shopify. You give us permission to process it to provide the service to you, as described in our privacy policy, and for no other purpose. You are responsible for having the right to connect a platform and for what you choose to share publicly, such as a pitch kit link. Connecting a platform is also subject to that platform's own terms.
4. Retailer information
Information about retailers and distributors is gathered from what they publish and from other public sources, and is presented with its source and with what we do not know. It can be out of date or wrong. Check it before relying on it, and tell us when you find an error.
5. AI-generated analysis
Parts of the service use an AI model to summarise and extract information from your data and from retailers' own public pages. Every claim it produces links to its source so you can check it, and you can correct or dismiss anything. Even so, AI output can be incomplete or mistaken. Do not treat it as advice, and verify anything you act on, particularly figures such as prices, quantities and dates.
6. Acceptable use
You agree not to:
- connect a mailbox, store or account you do not have the right to connect;
- use the service to send unsolicited bulk communications or to harvest contact details;
- attempt to access another customer's data or to probe, scan or disrupt the service;
- copy, resell or scrape the retailer dataset or the service as a whole;
- use the service in breach of any law that applies to you.
7. Fees
The service is currently offered without charge. If we introduce paid plans we will tell you in advance, and nothing you already have will be moved behind a charge without notice and a chance to export or delete your data.
8. Ending the agreement
You can stop using the service at any time and ask us to delete your account by emailing privacy@shelfwyze.com. We can suspend or end your access if you break these terms, or on 30 days' notice if we discontinue the service, in which case you may export your data first.
9. No warranty
The service is provided as is. We do not warrant that it will be uninterrupted or error-free, that retailer information is accurate, or that any recommendation, analysis or pitch will produce a particular result. To the fullest extent the law allows, we disclaim all implied warranties.
10. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or business, arising from your use of the service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim, or one hundred US dollars if you have paid nothing.
11. Changes to these terms
We may update these terms. We will change the date at the top and, for material changes, email account holders before they take effect. Continuing to use the service after that is acceptance of the new terms.
12. Governing law
These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules, and any dispute will be brought in the courts there.
